Introduction

These terms and conditions apply to the services available from the domain of http://www.goldenbids.co.uk. Your use of our services is governed by the following terms and conditions, (“User Agreement"). Before you can become a member of Goldenbids, you must read and accept all of the terms and conditions of this User Agreement.
The User Agreement is valid from 29 October 2008 and comes into effect for all new users. This document constitutes a legally binding agreement between the User and Goldenbids.
 
Eligibility and Registration
You may not use this website if you are under the age of 18 or you are not able to form a legally binding contract. Each user may register only once under their postal address (only the actual residence, no PO Box numbers). During the registration process, the user must choose a user name. Goldenbids has the right to change or delete the user name if it finds any user name offensive. The associated password is to be kept secret by the User. In general, the User shall be liable for all activities that are undertaken using the user account together with the associated password.
Goldenbids can at any time temporarily or to permanently disqualify a User. Users will be disqualified when it is believed that a member has violated statutory provisions or the rights of third parties. A disqualification can also occur if Goldenbids has another justified interest. For example, for the protection of other Users, or to prevent manipulation, in particular if bids are not paid, if unauthorised bidding software is used, or several user accounts are set up by the same User. Goldenbids reserves the right in its absolute discretion to restrict the number of sales in which a User may participate in or may win.
 
Bid Purchasing for Online Bidding/Payment
Bidding rights, called “bids” have to be purchased by users prior to bidding. Only registered users have the right to submit bids on the Goldenbids website. These bids can be purchased in packages (called “Bid Packages”) at the currently advertised price currently at of 30 pence per bid. The bids must be paid for in advance. Purchased Bid Packages are non refundable. Payment can be made via PayPal, who now take debit and credit cards. A contract for the purchase of the bids is in force as soon as the bids are purchased and deposited into the user’s account. In the event of any payment not being honoured Goldenbids reserve the right to suspend access to the user’s account until payment of the invoice amount is received in full.
 
Bidding/Bid Buddies
Bidding can be conducted by the user clicking the “bid” button on the website, or “Bid Buddies can be setup to bid on the User’s behalf. Once a bid is submitted it is deducted from the User’s account.
The Bid Buddies system to which each user has access gives users the ability to bid on items even if they are not online. The bid buddy automatically submits bids according to the specifications set in advance by the User.
The User is prohibited from using bidding software not authorised by Goldenbids and doing so will result in immediate disqualification from use.
 
The Bidding Process
When a user submits a bit either by clicking the “bid” button or using the bid buddy system, the price of the item will increase by 5 pence, this ensures the members of golden bids, receive maximum savings on the item.
A bid submitted by the User constitutes an offer from that User to Goldenbids to conclude a contract to purchase the item. A contract to purchase the item does not come into effect until the auction is finished and the last bidder has paid for the item in full, either by using credits from previous unsuccessful auctions or PayPal. When a new bid is placed the time left for the auction to run increases by typically 10 seconds, just like you would see in a real auction room.
Goldenbids reserve the right to change the auction times at any time and to add or remove products from the Goldenbids website.
The auction ends when no more bids are submitted within the remaining time stated. The User who is the last to bid wins the product. There will be no refund for all other bids placed when the auction is finished. The last bidder is determined by what data is shown on the Goldenbids database. Goldenbids decision is final on who the last bidder was.
Should a technical problem occur which may affect the Goldenbids auction the countdown timers for all live auctions will be paused until the issue has been resolved. Auctions will continue as the system is brought back up. The auctions will be restarted from the same time they were prior to the technical problem. Alternatively, Goldenbids holds the right to restart all auctions, when the technical problem(s) has (have) been rectified.
 
Notification/Acceptance of the Win/Payment
After the auction has ended, the last bidder i.e. the winner will receive an email from Goldenbids entitled “you have won an auction” This email contains a link to direct the user to the payment page on the Goldenbids server. Once payment is received the item will be dispatched to the winner bidder’s registered address, with 14 days, although in most cases this will be much less. In the event that the winner has not paid within 14 days the option to purchase the product expires. There is also no entitlement of a refund of any bids used.
 
Cancellation
Goldenbids grants to the user the right to cancel in accordance with statutory provisions on mail order sales. If any item has been tampered with, or, if the seal on any media has been broken by the consumer, the right to cancel is withdrawn. You may cancel your contract within two weeks in written form (e.g. letter, or e-mail) or by returning the items unused. To initiate the cancellation process email sales@goldenbids.co.uk
 
Returns
If the User is unable to return to Goldenbids the product received or can only return it in part, or in a depreciated condition, the User will have to pay compensation to Goldenbids unless the product proves to be faulty. The customer is required to pay the costs for the return of the item (unless the item is faulty). Should Goldenbids incur additional costs for insufficient postage on the return of the item; these costs will be deducted from any payment remitted by the customer. Products can only be returned in their entirety.
 
Delivery
Deliveries are made solely within the UK (exclusively on the mainland, or only upon inquiry) normally within 14 days, although in exceptional circumstances, this may take longer.
Goldenbids are entitled to substitute an item with a comparable replacement product with at least the same features.
 
Liability
Goldenbids are not liable for faulty operation of the computer system during bid submission and for incorrect or slow transmission of bidding data caused by the internet provider. Should this occur, the bidder will have no legal right to the purchase of the item.
 
Guarantee/Return policy
The items are supplied fit for any reasonable purpose. The item descriptions are provided to the best of Goldenbids knowledge in order to provide information to the User. Images of products can, on occasions, differ from the original.
The User has the right to return a faulty item within a reasonable period of time. The User must also return all the warranty information to Goldenbids with the item. If the User chooses to return the item to Goldenbids, please email the Returns Centre at sales@goldenbids.co.uk
 
Incorrect Product Delivery
The User will be required to send the incorrect item back to Goldenbids as instructed by the customer service advisor. Goldendbids will send a replacement upon receipt of the incorrect product.
